EU and US agree on controversial data transfer
EU and the US have agreed in principle on the controversial transfer of data between the European Union and the US. Lengthy discussions have included American companies saying EU-regulations are too strict and that they could force US-companies to stop businesses in Europe.
The European Commission and the United States have now announced that they have agreed in principle on a new Trans-Atlantic Data Privacy Framework for trans-Atlantic data flows and that the agreement addresses the data protection and privacy concerns raised by the Court of Justice of the European Union.
First reactions from business leaders were positive with Microsoft calling it a “milestone”. Austrian lawyer and privacy activist Max Schrems, who has campaigned against Facebook for privacy violations and transfer of data, saying there is a lack of details.
“There is only a political announcement, not a text that can be analyzed. Lawyers still have to find solutions to the problems raised by the Court of Justice (CJEU). So far no fully functioning solutions were delivered despite two years of discussions”, he said on his website.
The parties in a joint statement say that the agreement “will provide a durable basis for trans-Atlantic data flows, which are critical to protecting citizens’ rights and enabling trans-Atlantic commerce in all sectors of the economy, including for small and medium enterprises.”

”The new Framework marks an unprecedented commitment on the US side to implement reforms that will strengthen the privacy and civil liberties protections applicable to US signals intelligence activities”.
”Under the Trans-Atlantic Data Privacy Framework, the United States is to put in place new safeguards to ensure that signals surveillance activities are necessary and proportionate in the pursuit of defined national security objectives, establish a two-level independent redress mechanism with binding authority to direct remedial measures, and enhance rigorous and layered oversight of signals intelligence activities to ensure compliance with limitations on surveillance activities.”
